These Terms and Conditions (“Terms”) apply when you access or use nsfwspace.com and its ArtGenerator image-generation workspace (the “Service”). By creating an account, purchasing credits, submitting a generation request, or otherwise using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not access or use the Service.

NSFWSpace is intended only for adults who are at least 18 years old and have reached the age of legal majority where they live. By using the Service, you represent that:

• you meet the applicable minimum age and have legal capacity to accept these Terms;
• access to adult or explicit material is lawful in your location;
• you are using the Service voluntarily and for lawful purposes;
• the information you provide is accurate and not misleading; and
• your use does not breach a law, court order, sanction, or obligation owed to another person.

Do not use the Service if adult content is prohibited where you are located.

The Service provides access to AI image-generation models, prompt and reference-image inputs, generation settings, result review, and a personal media library. Some models may support adult, explicit, or Not Safe for Work content.

Model availability, input support, safety restrictions, prices, credit costs, output characteristics, and provider rules can vary or change. The Service does not guarantee that every prompt will be accepted or that an output will match your request.

You are responsible for protecting your login credentials and for activity performed through your account. Do not share, sell, transfer, or permit another person to use your account. Notify support promptly if you suspect unauthorized access.

We may ask for information reasonably needed to confirm account ownership, investigate abuse, or protect the Service.

Our Privacy Policy explains how account information, prompts, reference inputs, generated media, transactions, technical information, and support requests are handled.

Adult-oriented prompts or media can reveal sensitive interests. Submit only the information and media needed for the generation and only when you have the right to do so.

If you are in the EU, EEA, UK, California, or another jurisdiction with mandatory privacy or consumer protections, those protections apply to the extent required by law. Nothing in these Terms excludes a right or remedy that cannot lawfully be excluded.

Privacy requests can be submitted through support. Purchase withdrawal and refund rights are addressed in section 14 of these Terms and applicable mandatory law.

You must not use the Service to create, upload, request, store, or distribute material that:

• sexually depicts, exploits, grooms, or endangers a minor, including fictional, illustrated, or generated depictions;
• contains non-consensual intimate imagery or sexual content involving an identifiable person without the necessary consent and rights;
• facilitates illegal activity, abuse, trafficking, harassment, threats, stalking, or real-world violence;
• infringes copyright, trademark, privacy, publicity, contractual, or other third-party rights;
• impersonates or deceptively represents a real person or authentic evidence;
• contains malware or attempts to compromise the Service, another account, or a provider;
• uses automated scraping, probing, load testing, or extraction without written authorization; or
• otherwise violates applicable law, these Terms, or the selected provider’s rules.

You may use another person’s name, likeness, voice, private material, or intimate imagery only when you have a lawful basis and all necessary permission. Public availability of an image does not by itself establish consent for sexual, defamatory, deceptive, or commercial use.

Do not generate or present synthetic content as an authentic recording, photograph, statement, or endorsement by a real person. You are responsible for disclosures required when publishing or using synthetic media.

You remain responsible for every prompt, upload, reference image, generated result, library item, and use of an output. You represent that you have the rights needed to submit each input and instruct us and the selected provider to process it.

You retain whatever rights you already hold in your inputs. You grant the Service a limited, worldwide license to host, transmit, reproduce, transform, and display inputs and outputs only as reasonably needed to operate, secure, support, and improve the Service.

Rights in AI-generated output vary by jurisdiction and provider. We do not promise that an output is unique, eligible for copyright, or free from third-party rights. Similar or identical results may be generated for other users.

If you believe material available through the Service infringes your copyright or another legal right, submit a detailed report through support. Include your contact information, identification of the protected work or right, the location of the reported material, the basis for your claim, and a good-faith statement that the information is accurate.

Knowingly false or abusive notices can create legal liability. We may remove or restrict material while a report is reviewed.

AI generation is probabilistic. Outputs can be inaccurate, incomplete, biased, offensive, explicit, visually defective, unexpectedly similar to existing material, or inconsistent with your prompt. Review every output before saving, sharing, publishing, or relying on it.

We do not exercise real-time editorial review over every generation and do not guarantee the accuracy, legality, suitability, provenance, or safety of provider output.

The Service and its generated output do not constitute medical, legal, financial, psychological, safety, or other professional advice, and are not an emergency service. Obtain appropriate professional assistance for decisions or emergencies requiring it.

Generation can require credits. Welcome credits are a one-time account grant. Paid credit packs are one-time purchases and do not renew automatically. The price, currency, credit amount, and payment method displayed at checkout govern the purchase.

Credits have no cash value, are not legal tender, and cannot be transferred or redeemed for money unless the Service expressly says otherwise. A credit is granted only after successful payment confirmation. Payment providers process billing details under their own terms and privacy notices.

You may request a refund within 14 days of purchase when none of the purchased credits have been used. Once any credits from a pack have been used for generation, that pack is generally non-refundable because the digital service has begun, except where mandatory consumer law requires otherwise.

Report duplicate or unauthorized charges promptly. If a confirmed payment did not add the purchased credits, contact support with the account email, order number, and purchase date so the order can be verified, corrected, or refunded where appropriate.

Credit packs are one-time purchases, not subscriptions, and do not renew automatically. You may request account closure through support, but closing an account does not automatically reverse a completed purchase. Remaining credits have no cash value unless applicable law requires otherwise.

The Service depends on third-party model providers, payment processors, authentication services, hosting infrastructure, and other vendors. A third party’s own terms and privacy notice govern its service. We do not control or guarantee a third party’s availability, output, security, policies, or continued participation.

To the extent permitted by law, you are responsible for losses, claims, and reasonable costs arising from your unlawful use of the Service, your inputs or publication of outputs, your breach of these Terms, or your infringement of another person’s rights. This section does not apply where a claim results from conduct for which the Service operator is legally responsible.

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We do not promise uninterrupted operation, permanent availability of a model or provider, error-free output, preservation of every file, or fitness for a particular purpose.

Nothing in these Terms excludes warranties or guarantees that cannot legally be excluded.

To the maximum extent permitted by law, the Service operator and its providers are not liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from use of or inability to use the Service, loss of data, provider output, unauthorized account activity, or third-party conduct.

This limitation does not apply to liability that cannot legally be limited, including mandatory consumer rights or liability arising from fraud, wilful misconduct, or other non-excludable grounds.

We may limit, suspend, or terminate access when reasonably necessary to protect users, providers, payment systems, or the Service; investigate fraud or security incidents; comply with law; address a material breach; or respond to prohibited content.

You may stop using the Service or request account deletion. Provisions that by their nature should survive termination—including rights, payment records, disclaimers, responsibility for violations, and dispute provisions—remain effective.

Before starting formal proceedings, contact support with a description of the issue and the resolution requested so both sides have a reasonable opportunity to resolve it informally.

Nothing in this section prevents either side from seeking urgent protective relief or using a court, regulator, consumer-protection process, or alternative dispute mechanism available under applicable mandatory law.

These Terms are governed by the laws applicable to the Service operator, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections or access to courts available under the law of your habitual residence.

We may update these Terms as the Service, providers, pricing model, or legal requirements change. The effective date will be revised when updated Terms are published. Material changes will receive additional notice where required. Continued use after the new effective date constitutes acceptance, except where law requires another form of consent.

We are not responsible for delay or failure caused by events beyond reasonable control, including natural disasters, war, civil disturbance, government action, labor disputes, internet or power failures, cyberattacks, provider outages, payment-network disruption, or changes imposed by third-party AI providers.

If a provision is unenforceable, it will be limited only as much as necessary and the remaining Terms will continue. Failure to enforce a provision is not a waiver. You may not assign your account or these Terms without consent; the Service operator may assign them as part of a reorganization, financing, merger, acquisition, or sale of assets.
